Terms & Conditions

These Terms & Conditions govern your access to and use of Tamagana. By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Operator and contact

Tamagana is operated by Tiengos. References to “Tamagana,” “Tiengos,” “we,” or “us” mean the operator of the Service. These Terms do not limit rights that cannot be waived under applicable consumer law.

2. Eligibility and accounts

  • You must be legally able to enter into this agreement. If local law requires authorization from a parent or guardian, you may use the Service only with that authorization.
  • You must provide accurate account information and keep it reasonably current.
  • You are responsible for safeguarding your sign-in method and for activity carried out through your account. Tell us promptly if you suspect unauthorized access.
  • Accounts are personal and may not be sold, transferred, or shared in a way that circumvents plan limits or security controls.

3. The Service

Tamagana is a language-learning service for reading, translation, vocabulary, flashcards, cloze, speaking and translation practice, AI-generated or imported texts, generated audio, progress tracking, and related features.

Levels, scores, translations, feedback, recommendations, and other results are learning aids and estimates. They are not certified proficiency assessments or professional, academic, legal, medical, or employment advice.

The Service continues to evolve quickly. We expect to add many features, while existing features may change substantially or remain unavailable for some languages as we improve them. The beta designation describes this faster pace of product change; it does not mean that we apply lower security standards.

4. Free and paid plans

  • Some features are free and others require Tamagana Pro. The price, currency, billing interval, included features, and any limits shown at checkout form part of your purchase.
  • Eligible accounts may receive a trial. Its duration, price, and the charge that follows are shown before checkout. Unless you cancel before the trial ends, the selected paid subscription begins automatically.
  • Paid subscriptions renew automatically for the selected monthly or annual interval until canceled. Our payment provider processes payment using the method on file. Taxes or price changes will be handled as disclosed at checkout and required by law.
  • You may cancel using the subscription-management method made available through the Service or by contacting us. Unless the checkout terms or mandatory law say otherwise, cancellation stops future renewal and access continues until the end of the paid billing period.
  • Refunds and statutory withdrawal rights are governed by applicable law and the information provided at purchase. Nothing in these Terms removes a mandatory right to a remedy for a digital service that is not supplied as agreed.

5. Your content

You retain ownership of texts, prompts, recordings, answers, and other material you submit (“User Content”). You do not gain ownership of Tamagana software, provider technology, or material owned by others.

You grant us a non-exclusive, worldwide, royalty-free license to host, copy, format, analyze, translate, generate learning materials and audio from, and otherwise process User Content only as needed to operate, secure, and improve the Service. If you make content public, this license also lets us display, distribute, and recommend it through Tamagana.

Private texts are available through your account and to service providers or personnel only as needed to operate the Service. Public texts can be viewed by other users and may remain available in anonymized form after account deletion.

You must have the rights and permissions needed to submit User Content. Do not upload material that is unlawful, infringing, confidential without permission, or that exposes another person's personal data without a lawful reason. We may review, restrict, unpublish, or remove content to enforce these Terms or protect the Service and its users.

6. AI, translations, and voice features

AI and speech providers help generate texts, translations, definitions, exercises, feedback, transcripts, and audio. Outputs can be incomplete, inaccurate, biased, offensive, or similar to material produced for others, and may not be available for every language or dialect.

You are responsible for reviewing outputs before relying on, publishing, or sharing them. Do not submit secrets or sensitive personal data, and do not use the Service to make high-impact decisions about another person.

7. Acceptable use

You must not use or help others use the Service to:

  • break the law or another person's rights, including intellectual-property, privacy, publicity, or data-protection rights;
  • harass, exploit, threaten, defraud, impersonate, or harm another person, or create or distribute unlawful or seriously harmful material;
  • scrape, crawl, bulk-download, benchmark, resell, or automate access in a way that is unauthorized, bypasses limits, or interferes with normal operation;
  • probe, reverse-engineer, disrupt, overload, introduce malware, evade access controls, or attempt to gain unauthorized access, except where applicable law expressly permits it;
  • misrepresent your identity, affiliation, subscription eligibility, or the origin of content;
  • publish content you do not have the right to share or use voice and AI features to violate another person's rights.

8. Tamagana intellectual property

The Service's software, design, branding, interfaces, and original materials are owned by Tiengos or its licensors and are protected by law. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service. This section does not claim ownership of User Content or third-party material.

9. Third-party services and content

Tamagana depends on third-party providers for authentication, storage, analytics, diagnostics, payments, AI, speech, and email. Their services may be subject to separate terms and privacy notices. Links or imported third-party material do not mean that we endorse or own that material.

10. Availability, limits, and changes

We aim to keep the Service available but do not promise uninterrupted or error-free operation. Maintenance, provider failures, security events, legal requirements, or product development can interrupt or change features. We may introduce, change, or retire features and reasonable usage limits.

We may limit unusually heavy, abusive, automated, or security-sensitive usage even when a plan is described as having high limits. If a change materially reduces a paid feature during a current billing period, any remedy will be provided as required by applicable law.

11. Suspension and termination

You may stop using the Service at any time. We may restrict, suspend, or terminate access when reasonably necessary to address a Terms violation, security risk, unlawful activity, non-payment, provider or legal requirement, or material harm to the Service or others. Where appropriate, we will give notice and an opportunity to remedy the issue.

Ending access does not automatically erase all data. Data is handled under the Privacy Policy, including the rule that deliberately public texts may remain available without being linked to your account.

12. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available.” We do not promise that every output, translation, score, audio file, recommendation, or saved item will be accurate, suitable, available, or preserved. Mandatory statutory guarantees and remedies remain unaffected.

13. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including mandatory consumer rights. To the extent permitted by law, we are not responsible for losses that were not caused by our breach, were not reasonably foreseeable when you agreed to these Terms, or result from unauthorized or unlawful use of the Service.

14. Changes to these Terms

We may update these Terms when the Service, business model, providers, or legal requirements change. We will post the revised Terms with a new effective date and provide additional notice for material changes when required. Changes do not retroactively reduce rights you already have under mandatory law.
